Quantification of PD-L1 expression in tumor tissue using immunohistochemistry (IHC) assays is currently the most widely validated, used, and accepted biomarker to guide the selection of patients to receive immune checkpoint inhibitor (i.e., anti-PD-1 or anti-PD-L1) therapies.

Strata Oncology offers PD-L1 IHC testing alongside Strata Select testing. A single test requisition form and sample submission will provide you with comprehensive genomic profiling results and PD-L1 expression to help inform targeted therapy and immunotherapy decisions.

Ordering

PD-L1 IHC testing cannot be ordered as a stand alone test. It may be ordered alongside Strata Select testing, but it is not required.

PD-L1 IHC testing, which will be billed separately, can be added to a Strata Select order by choosing the appropriate clone in either the portal or on the paper requisition form.

There are no special or additional specimen requirements for adding PD-L1 IHC testing to a Strata Select order if a block is being sent. If slides are being sent, then three (3) additional slides must be sent.

When ordering, the desired clone should be specified (see table).

If there is not enough tissue to perform both Strata Select and PD-L1 IHC testing, Strata will reach out to you and request more tissue. If this isn’t possible only Strata Select will be performed.

The Strata Oncology Financial Assistance Program is available to help commercial insurance patients, Medicaid patients and patients with no insurance with out of pocket costs.

PD-L1 IHC Clone Information

The following table lists tumor types for which there is an FDA-approved PD-L1 IHC companion diagnostic available.

Some tumor types have more than one clone available. The ordering physician should order the clone associated with the therapy they are considering for their patient.

If an approved companion diagnostic is not available for the patient’s tumor type, it is the physician’s choice which clone to order. Clone 22C3 is generally considered the default choice in these situations.

No Surprises Act

Your Rights and Protections Against Surprise Medical Bills

When you get emergency care or get treated by an out-of-network provider at an in-network hospital
or ambulatory surgical center, you are protected from surprise billing or balance billing.

What is “balance billing” (sometimes called “surprise billing”)?

When you see a doctor or other health care provider, you may owe certain out-of-pocket costs, such as
a copayment, coinsurance, and/or a deductible. You may have other costs or have to pay the entire bill
if you see a provider or visit a health care facility that isn’t in your health plan’s network.

“Out-of-network” describes providers and facilities that haven’t signed a contract with your health plan. Out-of-network providers may be permitted to bill you for the difference between what your plan agreed to pay and the full amount charged for a service. This is called “balance billing”. This amount is likely more than in-network costs for the same service and might not count toward your annual out-of-pocket limit.

“Surprise billing” is an unexpected balance bill. This can happen when you can’t control who is involved in your care—like when you have an emergency or when you schedule a visit at an in-network facility
but are unexpectedly treated by an out-of-network provider.

You are protected from balance billing for:

Emergency services

If you have an emergency medical condition and get emergency services from an out-of-network provider or facility, the most the provider or facility may bill you is your plan’s in-network cost-sharing amount (such as copayments and coinsurance). You can’t be balance billed for these emergency services. This includes services you may get after you’re in stable condition, unless you give written consent and give up your protections not to be balanced billed for these post-stabilization services.

Certain services at an in-network hospital or ambulatory surgical center

When you get services from an in-network hospital or ambulatory surgical center, certain providers there may be out-of-network. In these cases, the most those providers may bill you is your plan’s in-network cost-sharing amount. This applies to emergency medicine, anesthesia, pathology, radiology, laboratory, neonatology, assistant surgeon, hospitalist, or intensivist services. These providers can’t balance bill you and may not ask you to give up your protections not to be balance billed.

If you get other services at these in-network facilities, out-of-network providers can’t balance bill you, unless you give written consent and give up your protections.

You’re never required to give up your protections from balance billing. You also aren’t required
to get care out-of-network. You can choose a provider or facility in your plan’s network.

Your health benefit plan may or may not provide coverage for all of the health care services you are scheduled to receive or the providers providing those services. You may be responsible for the costs of the services that are not covered by your health benefit plan.

The nonparticipating provider must provide a good-faith estimate of the cost of the health care services to be provided. A good-faith estimate does not take into account unforeseen circumstances, which may affect the cost of the health care services provided. Generally, the good faith estimate for Strata Oncology’s Strata Select test is based on the actual list charge, which is $6500.00; however, the good faith estimate may be less if a patient qualifies for financial assistance.

You also have a right to request that the health care services be performed by a provider that participates with your health benefit plan, and may contact your carrier to arrange for those services to be provided at a lower cost and to receive information on in-network providers who can perform the health care services that you need.

When balance billing isn’t allowed, you also have the following protections:
  • You are only responsible for paying your share of the cost (like the copayments, coinsurance, and deductibles that you would pay if the provider or facility was in-network).
    Your health plan will pay out-of-network providers and facilities directly.
  • Your health plan generally must:
    • Cover emergency services without requiring you to get approval for services in advance (prior authorization).
    • Cover emergency services by out-of-network providers.
    • Base what you owe the provider or facility (cost-sharing) on what it would pay an in‑network provider or facility and show that amount in your explanation of benefits.
    • Count any amount you pay for emergency services or out-of-network services toward your deductible and out-of-pocket limit.

If you are a patient, we treat all health information that you provide to us directly as health information under Strata’s Notice of Privacy Practices.

Assignment

The period for mediation shall be thirty (30) days unless the parties mutually agree to an extension. If mediation fails, the parties will arbitrate the dispute pursuant to the applicable rules of the Judicial Arbitration and Mediation Services (“JAMS”). Any arbitration shall take place in Richmond, Virginia, before an arbitrator chosen from JAMS. Any award shall be final, binding, and conclusive upon the parties, and a judgment rendered thereon may be entered in any court having jurisdiction thereof. The arbitrator may award any form of remedy or relief (including injunctive relief, such as temporary restraining orders, preliminary and permanent injunctions) that would otherwise be available in court. Any award pursuant to said arbitration shall be accompanied by a written opinion of the arbitrator setting forth the reason for the award. To the extent not inconsistent with applicable laws, the arbitrator will have the authority to hear and grant motions and applications, including on an ex parte or expedited basis. The award rendered by the arbitrator shall be conclusive and binding upon the parties hereto, and judgment upon the award may be entered, and enforcement may be sought in, any court of competent jurisdiction. The prevailing party in any dispute relating to this Agreement shall be entitled to recover associated costs, including reasonable attorneys’ fees.

To the fullest extent permitted by applicable law, no arbitration under this Privacy Policy shall be joined to an arbitration involving any other party, whether through class arbitration proceedings or otherwise.

Predictive biomarkers for benefit from a variety of approved and investigational antibody-drug conjugates (ADCs); based on a proprietary calculation method of three components including ADC target expression.

Immunotherapy Response Score

Immunotherapy Response Score is a pan-solid tumor predictive diagnostic tool for anti-PD-1/PD-L1 monotherapy benefit.
